Please read the following terms and conditions carefully.

 

The renter agrees to the following conditions:

• Equipment requires a clean, level surface, with no dirt or gravel;

• No face paint allowed on the equipment;

• No water on the equipment;

• No food on the equipment;

• No animals or pets on the equipment;

• Bounce house weight limit is 200 lbs.;

• Renter must provide a shaded area or canopy when outside temperature exceeds 89 F.

• This Rental Agreement (the "Agreement") is entered into between Party Time Co. (referred to as "Company") and the customer (referred to as "Renter") as of the date of signing this Agreement.

1. Rental Equipment: The Company agrees to rent the equipment specified in the rental order to the Renter.

2. Rental Period: Please refer to the rental period as listed on the booking form you submitted through our site.

3. Delivery and Pickup: The Company will deliver the rented equipment to the agreed-upon location and pick it up at the end of the rental period. The Renter agrees to provide a safe and accessible location for delivery and pickup. If the Renter fails to meet the agreed-upon delivery or pickup schedule, additional charges may apply.

4. Rental Fee and Payment: The Renter agrees to pay the Company the rental fee specified in the rental order. The payment must be made in full 3 days prior to event date. Additional charges may apply if the equipment is not returned on time or if there are any damages.

5. Security Deposit: The Renter agrees to pay a $100 non-refundable deposit to secure the rental. The non-refundable security deposit will be applied to the rental fee specified in the rental order. If you're getting a balloon arch for your event, we require a separate $50 non-refundable deposit.

6. Assumption of Risk: The Renter understands and acknowledges that using the rented equipment, including but not limited to bounce houses, soft play equipment, ball pits, balloon arches, and any other rental items, involves inherent risks. These risks include but are not limited to, potential injuries, accidents, or damages arising from falls, collisions, misuse, or unforeseen circumstances. Potential injuries can result in permanent disabilities, and even death.

7. Release and Indemnity: The Renter agrees to release, indemnify, and hold harmless the Company, its employees, agents, and representatives from any and all liability, claims, demands, actions, or causes of action arising out of or related to the use of the rented equipment. This includes but is not limited to, any personal injuries, property damage, or other losses incurred by the Renter or any third party during the rental period.

8. Assumption of Responsibility: The Renter assumes full responsibility for the supervision and safe use of the rented equipment. The Renter agrees to take all necessary precautions to ensure the safety of all participants and users (children and adults), including but not limited to proper adult supervision, adhering to weight and height restrictions, and following all safety guidelines provided by Party Time Co.

9. Exclusion of Liability: To the fullest extent permitted by law, the Company expressly disclaims any liability for any direct, indirect, incidental, consequential, or special damages arising from or in connection with the use of the rented equipment. This includes but is not limited to, any injuries, accidents, damages to persons or property, and death.

10. Compliance with Laws and Regulations: The Renter agrees to comply with all applicable laws, regulations, and guidelines for using the rented equipment. This includes but is not limited to, any local or state regulations governing the safety, setup, operation, and supervision of the equipment.

11. Safety Guidelines and Instructions: The Renter acknowledges that they have received and will follow all safety guidelines, instructions, and recommendations provided by the Company for using the rented equipment. Failure to adhere to these guidelines may increase the risk of accidents or injuries and may void this disclaimer of liability.

12. Inclement Weather: Bounce House. a. Rain: In the event of very light rain, it is generally safe to operate our bounce houses. However, if the weather conditions pose a risk to the safety of participants or if heavy rainfall makes the equipment unsafe or unusable, we reserve the right to cancel or postpone the rental. b. High Winds: Bounce houses cannot be operated in high winds or gusty conditions. If wind speeds exceed the safe operating limits specified by the manufacturer (typically 18 mph), we will not set up or operate the bounce house. Please note, in case of inclement weather, the Renter may opt to have the bounce house set up inside away from the elements. It is the Renter's responsibility to make sure they have the space needed for such arrangements (13ft long x 8ft wide - 9ft tall ceilings required).

13. Inclement Weather: Soft Play. a. Rain: Soft play equipment should not get wet.  In the event of rain, we reserve the right to cancel or postpone the rental. b. High Winds: Soft play equipment cannot be operated in high winds or gusty conditions. If wind speeds exceed the safe operating limits specified by the manufacturer (typically 18 mph), we will not set up or operate the bounce house. Please note, in case of inclement weather, the Renter may opt to have soft play equipment set up inside away from the elements. It is the Renter's responsibility to make sure they have the space needed for such arrangements. (10ft x 12 ft).

14. Inclement Weather: Balloon Arch: For customers purchasing a balloon arch. Party Time Co. agrees to use professional quality latex balloons from the following suppliers: Sempertex, Tuftex and Qualatex. Please be advised that balloons, regardless of quality, may be susceptible to popping when exposed to sunlight and heat, and may be subject to movement or displacement in windy conditions. It is also important to note that balloons will oxidize when outdoors in sunlight. This may cause a cloudy, matte look. Please also note that once the balloons are set up, any popping or movement thereof due to sunlight, heat, or wind conditions shall not be our responsibility.

15. Ball Pit Balls: Please note that ball pit balls may become compressed or "cave in" during colder weather. This is a natural reaction to temperature changes and will typically resolve once the temperature returns to normal. While this is not a defect, we want to ensure you're aware of this possibility during colder months.

16. Cancellation by the Renter: If the Renter cancels the rental due to inclement weather or any other reason, they must notify the Company at least 24 hours before the scheduled delivery time. In such cases, the Renter will receive a full refund of any rental fees paid, excluding the $100 non-refundable deposit.

17. Cancellation by the Company: a. Weather-related Cancellation: If the Company determines that weather conditions, such as heavy rain or high winds, pose a risk to the safety of participants or equipment, we reserve the right to cancel or postpone the rental. In such cases, the Renter will receive a full refund of any rental fees paid, excluding the $100 non-refundable deposit. The Company will make reasonable efforts to notify the Renter as soon as possible in such situations. b. Non-weather-related Cancellation: The Company reserves the right to cancel or refuse service if the Company believes that the rental conditions, location, or any other factors may risk the safety of participants, our staff, or the equipment. In such cases, the Renter will receive a full refund of any rental fees paid, excluding the $100 non-refundable deposit. In the event of a weather-related cancellation, the Company will make reasonable efforts to accommodate the Renter's request to reschedule the rental, subject to availability. If a mutually agreeable alternative date and time are arranged, the rental fees will be transferred to the rescheduled date.

18. Damages and Cleaning: The Renter agrees to return the equipment in the same condition as received, with normal wear and tear expected. The Renter will be responsible for any damages, missing parts, or excessive cleaning required upon return. The Company reserves the right to charge the Renter for any repairs or replacement costs necessary.

19. Company Rules: The renter agrees to the following rules: Equipment requires a clean, level surface, with no dirt or gravel; No face paint allowed on the equipment; No water on the equipment; No food on the equipment; No animals or pets on the equipment; Bounce house weight limit is 200 lbs.; Renter must provide a shaded area or canopy when outside temperature exceeds 89 degrees Fahrenheit.

20. Governing Law: This Agreement shall be governed by and interpreted in accordance with the laws of North Carolina. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts in Pender County, North Carolina.

21. Entire Agreement: This Agreement constitutes the entire agreement between the Company and the Renter and supersedes any prior discussions, understandings, or agreements, whether written or oral, relating to the rental of the equipment.
